Kullanım Şartları

1. Taraflar
Bu şartlar, Mehmet Ayhan (Malatya, Türkiye) tarafından geliştirilen mCloud Yedek yazılımının ("Yazılım") kullanımına ilişkindir. Yazılımı kurarak veya kullanarak bu şartları kabul etmiş sayılırsınız.
2. Lisans
- Deneme sürümü, süre veya yedek sayısı sınırı dolana kadar ücretsiz kullanılabilir.
- Ücretli lisans, lisansın bağlandığı bilgisayarda kullanım hakkı verir. Yazılımın mülkiyeti geliştiricide kalır.
- Yazılımı kopyalamak, lisans korumasını aşmaya çalışmak, tersine mühendislik yapmak veya yeniden satmak yasaktır.
3. Bulut hesapları
Yedekler, sizin kendi Google Drive, OneDrive, pCloud vb. hesabınıza yüklenir. Bu hesapların kullanımı ilgili sağlayıcının kendi şartlarına tabidir; depolama kotası ve ücretleri sizin sorumluluğunuzdadır.
4. Kullanıcının sorumlulukları
- Yedek şifrelerinizi güvenli saklamak. Şifre kaybolursa şifreli yedekler açılamaz; geliştirici şifreyi kurtaramaz.
- Yedeklerin düzenli alındığını ve geri yüklenebildiğini ara ara kontrol etmek.
- Yazılımı yalnızca yedekleme hakkına sahip olduğunuz veriler için kullanmak.
5. Sorumluluğun sınırlandırılması
Yazılım özenle geliştirilmiştir ancak "olduğu gibi" sunulur. Donanım arızası, bulut sağlayıcısı kesintisi, internet bağlantısı, hatalı yapılandırma veya kaybolan şifre gibi geliştiricinin kontrolü dışındaki nedenlerle oluşan veri kayıplarından geliştirici sorumlu tutulamaz. Geliştiricinin toplam sorumluluğu, her durumda ilgili lisans için ödenen bedelle sınırlıdır.
6. Gizlilik
Verilerin nasıl işlendiği Gizlilik Politikası'nda açıklanmıştır.
7. Uygulanacak hukuk
Bu şartlara Türkiye Cumhuriyeti hukuku uygulanır. Tüketici işlemlerinde tüketici hakem heyetleri ve tüketici mahkemelerinin yetkisi saklıdır.

1. Parties
These terms govern the use of the mCloud Yedek software (the “Software”) developed by Mehmet Ayhan, Malatya, Türkiye. By installing or using the Software you agree to these terms.
2. License
- The trial version may be used free of charge until its time or backup-count limit is reached.
- A paid license grants the right to use the Software on the computer the license is bound to. Ownership of the Software remains with the developer.
- Copying the Software, circumventing its license protection, reverse engineering or reselling it is prohibited.
3. Cloud accounts
Backups are uploaded to your own Google Drive, OneDrive, pCloud or other account. Use of those accounts is subject to each provider's own terms; storage quotas and fees are your responsibility.
4. Your responsibilities
- Keep your backup passwords safe. If a password is lost, encrypted backups cannot be opened and the developer cannot recover it.
- Periodically check that backups are being made and can be restored.
- Use the Software only for data you have the right to back up.
5. Limitation of liability
The Software is developed with care but is provided “as is”. The developer is not liable for data loss caused by factors outside the developer's control, such as hardware failure, cloud provider outages, network problems, misconfiguration or lost passwords. In any case the developer's total liability is limited to the fee paid for the relevant license.
6. Privacy
How data is handled is described in the Privacy Policy.
7. Governing law
These terms are governed by the laws of the Republic of Türkiye, without prejudice to mandatory consumer protection rules.
